1. Who's who?

"Homee" or the "Company" refers to Homee, Inc., a Delaware corporation. When we use "We" or "Us" in this privacy policy, we are referring to Homee. The "Homee Platform" refers to this website and all applications and content provided by Homee. The Homee Platform and its content is designed to comply with U.S. laws and regulations. "You" or "Your" refers to the person using an account created on the Homee Platform, or otherwise using the website accessible through www.Homeeondemand.com.

2. What does this Privacy Policy Address?

This Homee Privacy Policy (this "Privacy Policy"), applies to the information that We or Our designees collect via the Homee Platform or by other means when You use the Homee Platform. This Privacy Policy is a part of the Homee Platform Terms and Conditions available at http://homeeondemand.com/legal/app-terms/ and the Homee - Provider Online Services Terms available at http://homeeondemand.com/legal/provider-terms/ (collectively, the "Terms"). When you accept the Terms, you also accept this Privacy Policy. You accept the Terms by either creating an account on the Homee Platform, or otherwise acknowledge your acceptance by selecting "I Agree" when using the Homee Platform. Certain parts of the Homee Platform may be available to You without creating an account or selecting "I Agree." If You use only those sections of the Homee Platform, your use or access of those parts of the Homee Platform acknowledges your acceptance of this Privacy Policy. If you are using the Homee Platform as part of your job, or on behalf of your employer, you are accepting it both on behalf of yourself personally, and on behalf of your employer. Capitalized terms that are not expressly defined in this Privacy Policy will have the meaning described in the Terms.

This Privacy Policy applies to information We ask You to provide to the Homee Platform. Any unsolicited information provided by You (e.g. by sending an email to Us or posting a question in an online chat session before You create an account) is non-confidential and will not be treated as private information. When You provide unsolicited information to Us, You grant Homee a nonexclusive, royalty-free, worldwide, perpetual, irrevocable, transferable and fully sublicensable right to use, copy, make derivatives from, and publish the unsolicited information for any lawful purpose and without limitation or attribution.

In an effort to alert You further concerning Homee's privacy practices, We may also collect, use or provide Your Personal Information (defined below) as disclosed in short "Privacy Notices" posted on the Homee Platform from time to time, or provided to You by email or in the process of Your using the Homee Platform. Such Privacy Notices are in addition to, and not in lieu of this Privacy Policy. To the extent they are different from this Privacy Policy, they will apply only to the specific Personal Information expressly discussed in the Privacy Notice. This Privacy Policy is intended to be construed together with any such Privacy Notice.

3. What Information We Gather

3.1 Personal Information

"Personal Information" means individually identifiable information about an individual collected from that individual by Homee through the Homee Platform or by other means (for example, by Your voluntarily submitting Personal Information to Us via the completion of a registration form or in an email You send to Us). The types of Personal Information that We may request or collect may include, without limitation, information about you in the following general categories:

  • Identification Information: When you seek to use the Homee Platform and to register as either a User or a Home Service Provider, We will ask for Your name, mailing address, email address, telephone number, and fax number and, for Home Service Providers We will request information Personal Information that may also may include, without limitation, Your business address, telephone number, e-mail address, website address, copies of your professional licenses and insurance coverage, and other relevant information to ascertain your ability to provide Homes Services to our other users.
  • Location Information: When you use the Company's services to request Home Services, or are a Home Service Provider seeking to provide Home Services to a User, we may collect precise location data about where the services are to be provided and the location of the Home Service Provider through the App. If you permit the App to access location services through the permission system used by your mobile operating system, we may also collect the precise location of your device when the App is running in the foreground or background. We may also derive your approximate location from your IP address or based on wireless towers or access points that connect to the device.
  • Contacts Information: If you permit the App to access the address book on your device through the permission system used by your mobile platform, we may access contact information from your address book to facilitate social interactions through our Homee Platform and for other purposes described in this Privacy Policy or at the time of consent or collection.
  • Home Service Information: We collect transaction details related to your use of our services, including the type of service requested, date and time the service was provided, amount charged, merchandise purchased and used for the Home Services, and other related transaction details.
  • Usage and Preference Information: We collect information about how you and site visitors interact with our services, preferences expressed, and settings chosen. In some cases we do this through the use of cookies, pixel tags, IP addresses and other technologies that may create and maintain unique identifiers.
  • Device Information: We may collect information about your mobile device, including, for example, the hardware model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.
  • Call and SMS Data: Our Homee Platform facilitates communications between Users and Home Service Providers (Professionals). In connection with facilitating this service, we receive call data, including the date and time of the call or SMS message, the parties' phone numbers, and the content of the SMS message.
  • Log Information: When you interact with the Homee Platform, we collect logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with the Homee Platform. We use Log Information to help improve the security and functionality of the Homee Platform, including by analyzing how users are using it.

Where there are links between the Homee Platform and third party sites or social networks, We may collect account information for accounts You use on those third party sites or social networks. We collect payment card and financial institution information as well, in order to allow Us to collect and distribute payments. In some instances, We may also collect geo-location data of Your mobile or other device, including, without limitation, GPS-based, Wi-Fi-based, or cell-based location information. Even though We don't view them as "Personal Information," We may also collect your internet protocol (IP) address, MAC address, or other machine identifiers as you access the Homee Platform.

We require registration in order for you to use the Homee Platform. As part of the registration process you will be required to provide Us with Personal Information. Some of the Personal Information that We ask you to provide is mandatory and some is voluntary. If you do not provide the mandatory information, you may not be able to use the Homee Platform or your use may be limited to only certain portions. We reserve the right to change which parts of the Website require registration, and which do not, as We modify and update the Homee Platform.

3.2 Accessing and Updating Your Personal Information

You may update Your Personal Information through the Homee Platform. If you should become aware that your Personal Information with Homee is not complete and accurate, you must promptly update your Personal Information via your account. It is your obligation to ensure that your Personal Information is kept up to date. This is important for many reasons, including allowing educational institutions to verify your use of the Homee Platform and credit you receive for the work you do through the Homee Platform. We may backup or replicate Personal Information stored through the Homee Platform for disaster recovery or other purposes. Updates to your Personal Information will not necessarily be reflected in such backups or replicated data when you make those updates.

3.3 Cookies

"Cookies" are small text files that are placed on your computer by websites that you visit. They are widely used in order to make websites work, or work more efficiently. Homee and its designees may use cookies or other technologies when you interact with the Homee Platform. If you disable Cookies in your browser, the Website may not operate correctly and you may not be able to use certain features of the Website.

This site is being monitored by one or more third-party monitoring software(s), and may capture information about your visit that will help us improve the quality of our service. 3.4 Adult Audiences Only

The Homee Platform is intended to be used only by persons over 13 years of age. We do not knowingly collect Personal Information or other information from or about children. You agree to notify Us immediately in writing referencing your Homee account, by mail at Homee, Inc., 3225 South MacDill Ave, Suite 129-270, Tampa, FL 33629, USA, or by email at legal@homeeondemand.com, if you become aware that We have received information from or about any such individuals. The Homee Platform may collect information intended to verify that you are an adult who is eligible to use the Company's services.

3.5 Third Party Sites

Some of Our services may be provided through sites that bear the names or trademarks of Our partners or suppliers, and that are not under Our control. In addition, the Homee Platform may contain links or other devices that take you to other websites that are also not within Our control, or pull content from such websites for display on the Homee Platform. Certain of those other websites may provide products or services to you directly or on Our behalf. We are not responsible for any aspect of other websites, including, without limitation, the privacy practices, products, services, or content of such websites. This Privacy Policy will not apply to such other websites. Rather, your activity and the information that you provide at such other websites will be subject to the privacy policies and other terms and conditions posted at those websites. You are responsible for reviewing those privacy policies and other terms and conditions prior to providing any Personal Information to those sites, regardless of whether or not you access them in connection with your use of the Homee Platform.

4. How We Use the Personal Information We Gather

4.1 Use of Information. 

Personal Information that you provide to Us is primarily processed and stored on the servers located within the United States. We may change the location of the servers from time to time, including to other countries, and without prior notice to you. Your Personal Information, however, will continue to be protected in accordance with United States law and this Privacy Policy. In the event of a change of ownership or restructuring of Homee (in whole or in part), any or all Personal Information maintained by Homee may be transferred to another entity, and such entity may then change this Privacy Policy in accordance with the Homee Platform Terms and Conditions. Changes of ownership or restructuring may occur without notice to you.

Homee may store and use your Personal Information and, without further notice to you, provide your Personal Information to Homee affiliates or to third parties in order for Us, Our affiliates or third parties to:

  • support Our intent to provide, maintain and improve usability of the Homee Platform including, for example, to prevent fraud and abuse of our services or the Homee Platform; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends;
  • collect and distribute payments;
  • provide, maintain, and improve our services and the Homee Platform, including, for example, to facilitate payments, send receipts, provide products and services you request (and send related information), develop new features, provide customer support to Users and Home Service Providers, develop safety features, authenticate users, and send product updates and administrative messages;
  • provide you with technical support;
  • provide you with access to restricted areas of the Homee Platform;
  • to send or facilitate communications (i) between a User and a Home Service Provider, such as estimated costs of Home Services Requested and any required materials needed to complete the Home Services, and (ii) times of arrival of a Home Service Provider;
  • comply with legal requirements, including, without limitation, governmental orders, civil subpoenas, or discovery requests;
  • enforce the Terms and Conditions of this Privacy Policy and the Terms and Conditions governing use of the Homee Platform and the Homee Provider Online Services Terms including, without limitation, the investigation of potential violations or suspected illegal activities;
  • protect the rights, property, safety or security of Homee, any of Our users or the public, or to respond to an emergency; or
  • accomplish or attempt to accomplish any other lawful purpose.

Some data, such as without limitation the types of services used and the numbers of users We receive daily in various parts of the Homee Platform, may be used for statistical, marketing, promotional, or any other lawful purposes. This kind of information is collected in aggregate/statistical form, without identifying any user individually.

4.2 Sharing of Information.

We also may share your information:

  • With Home Service Providers to enable them to provide the Home Services you request. For example, we share your name, photo (if you provide one), average User rating given by Home Service Providers;
  • With the general public if you submit content in a public forum, such as blog comments, social media posts, or other features of our services or those of Home Service Providers that are viewable by the general public provided that you agree not to intentionally share Personal Information in a public forum;
  • With third parties with whom you choose to let us share information, for example other apps or websites that integrate with our services, or those with a service with which we integrate;
  • With Our subsidiaries and affiliated entities that provide services or conduct data processing on our behalf, or for data centralization and/or logistics purposes;
  • With vendors, consultants, marketing partners, and other service providers who need access to such information to carry out work on Our behalf;
  • In response to a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process;
  • With law enforcement officials, government authorities, or other third parties if we believe Your actions are inconsistent with our User agreements, Terms of Service, or policies, or to protect the rights, property, or safety of Homee or others;
  • In connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company;
  • If we otherwise notify you and you consent to the sharing; and
  • In an aggregated and/or anonymized form which cannot reasonably be used to identify you

5. Protection of the Personal Information We Gather

Homee has implemented industry-standard measures to protect the security of the Personal Information We collect via the Homee Platform. For example, We use (SSL - Secure Socket Layers), a firewall and a digital certificate issued by RapidSSL to protect certain of Your Personal Information. The financial partners We use to collect and process payment information are PCI DSS (Payment Card Industry Data Security Standard) certified. The data center(s) where We host our servers are also SOC (formerly SAS 70) certified.

Regardless of what measures are used to protect Personal Information, no one can guarantee, and We do not guarantee, that your Personal Information is completely secure at all times. If We determine that your Personal Information was accessed in an improper manner, We will comply with applicable laws as We understand them and will cooperate with internal investigators or law enforcement (including by possibly disclosing your Personal Information to such investigators or law enforcement agencies).

Please understand that you are also responsible for maintaining the confidentiality of your Personal Information to protect it against unauthorized access or use including, without limitation, by ensuring that any credentials that enable access to the Homee Platform use strong passwords and are not shared with any third party. To the maximum extent permitted by applicable law, Homee disclaims any responsibility or liability for any misuse of your Personal Information that results from illegal, improper, malicious, or inappropriate acts or omissions of you or any third party, or from any conduct, other than willful conduct, of Homee.

Homee may retain your Personal Information for as long as you continue to use the Homee Platform, and for as long thereafter as permitted or required by applicable law. If We delete your Personal Information, it may still be contained on backup media or other systems until such times as such media is destroyed or overwritten, or data on such other systems are otherwise deleted.

6. Your Rights

In accordance with the applicable law, Homee will provide you with access to your Personal Information and, as appropriate, the right to intervene in respect of your Personal Information. You may also be entitled to request the deletion of your Personal Information, in which case, if Homee, in its sole discretion, deems deletion of such Personal Information as mandatory or appropriate, Homee may do so, provided, however that such deletion will mean that you may no longer be permitted to engage in certain activities, and may not have any further access to records of your use of the Homee Platform. For the purpose of exercising your rights, you shall submit a written request to Us in accordance with the applicable law referencing your Homee account, by mail at Homee, Inc., 3225 South MacDill Ave, Suite 129-270, Tampa, FL 33629, USA, or by email at legal@homeeondemand.com. In addition, if you believe that Homee has not complied with this Privacy Policy with respect to your Personal Information, please submit a sufficiently detailed complaint to Us in any of the foregoing manners. We will promptly investigate your complaint. Thereafter, We will take all measures We deem necessary to remedy the issues outlined in your complaint that We, in Our sole discretion, view as justified. If Homee deletes Personal Information, de-identified summaries, backup copies, and legal records may continue to contain portions of the Personal Information thereafter.

7. Your Choices

You can decide if You want to provide Your Personal Information to Homee. If you do not understand and agree to this Privacy Policy DO NOT provide Personal Information to Us. Please note, however, that if you do not provide certain Personal Information, you may not be able to use the Homee Platform, or access certain options at the Website. If You choose to receive communications regarding special offers, or any other information, We may add your Personal Information to Our email database and use (or direct Our designees to use) your Personal Information for providing such communications to you. You may later choose to unsubscribe from receiving such communications by following the unsubscribe directions in Our communications. If you provide Homee with inconsistent privacy preferences (for example, by indicating on one occasion that We may provide you with marketing offers and on another occasion that We may not), Homee will endeavor to update your privacy preferences in Homee's records with your latest preference in a timely manner. But We cannot guarantee how quickly such changes will take effect.
